DECISION FOR THE TOLLS ON THE MOTORWAYS IN MACEDONIA

According to article 103, paragraph 2 of the Public Roads Law (“Official Gazette of the Republic of Macedonia” no. 29/96 and 40/99) , the Government of the Republic of Macedonia on the session held on 27.06.2000 brought

DECISION
FOR THE FEE THAT NEEDS TO BE PAID FOR USAGE OF A MOTORWAY AND ITS SECTION

                                                 Article 1
This decision establishes the toll for usage of the motorway and its sections that is paid by the vehicles registered in the Republic of Macedonia (vehicles with domestic registration) and vehicles registered outside the Republic of Macedonia (vehicles with foreign registration).

                                                 Article 2
The fee for usage of a motorway and its section for the vehicles of article 1 of this Decision is established on   the basis of the retail price per liter fuel MB-98, according to the category of the vehicle and the length of the section. The payment is maid in denars.

                                                 Article 3
The vehicles that are paying a fee for usage of a motorway and its section are divided in the following categories :First category- motor vehicles with maximum clearance of H= 1,7 m and maximum clearance of L= 5,5 m (passenger vehicles) ;Second category-motor vehicles with maximum clearance H =3,3 m and maximum clearance L = 9,5 m (passenger vehicles with trail, jeeps, van and semi transportation vehicles) ;Third category-motor vehicles with maximum clearance H = 4,2 m and maximum clearance L = 10,5 m (jeeps with trail, semi transportation vehicles with trail, vans with trail, transportation vehicles and buses ) ;Fourth category- motor vehicles with clearance high higher than 4,2 m and clearance  length longer than 10,5 m(motor vehicles with trail , buses and buses ) .

                                                 Article 4
The fee for the first category, according to the length of the section on the motorway is established with the following amounts:

The fee for the second category, according to the length of the section on the motorway is established with the following amounts:

The fee for the third category, according to the length of the section on the motorway is established with the following amounts:

The fee for the fourth category, according to the length of the section on the motorway is established with the following amounts:

                                                 Article 5
The fee for usage of a motorway and its section is calculated in denars when the quantities from article 4 will be multiplied with the retail price per liter fuel MB-98. The fee adjustment is done within 5 days after the change of the retail price of the fuel, if the change is over 10% regarding to the last established price of the fuel.

                                                 Article 6
With the calculation of the amounts of the fee, the amounts from 1,00 to 4,99 are calculated to 5,00 , and the amounts from 5,00 to 9,99 on 10,00 denars.

                                                 Article 7
The adjustment of the fee with the retail price of the fuel is done by the Fund for National and Regional Roads .

                                                 Article 8
The owners of a motor vehicle can subscribe for usage of the named sections on the road with modes and conditions that are defined by the Fund for National and Regional Roads .

                                                 Article 9
The funds provided from the fee payment determined by this decision are revenues of the Fund for National and Regional Roads and are paid in a special account of the Payment Operations Bureau.

                                                 Article 10
With the entering into force of this decision, shall be no longer valid the Decision for the fee for usage of the sections on the motorways in the Republic of Macedonia for vehicles registered in the Republic of Macedonia (domestic registration) (“Official Gazette of Republic of Macedonia” no. 41/96 ) and the Decision for the fee for usage of the sections on a motorway in the Republic of Macedonia for vehicle with foreign registration (“Official Gazette of the Republic of Macedonia” no. 43/96 )

                                                 Article 11
This decision shall enter into force on the day of its publishing in the “Official Gazette of the Republic of Macedonia ”

According to article 36, paragraph 3 of the Law of the Government of the Republic of Macedonia (“Official Gazette of Republic of Macedonia” no. 59/2000, 12/2003, 55/2005 and 37/2006 ) and article 103, paragraph 2 of the Public Roads Law (“Official Gazette of Republic of Macedonia” no. 26/1996, 40/1999, 96/2000, 29/2002, 68/2004 and 31/2006), the Government of Republic of Macedonia on the session held on ____. 02.2007 brought

                                              DECISION
FOR THE AMOUNT AND THE METHOD OF PAYMENT OF THE FEE FOR USAGE OF A MOTORWAY OR NATIONAL ROAD , THEIR SECTIONS OR STRUCTURES ON THE ROAD (MOTORWAY TAX)

                                                 Article 1
With this decision is determined the amount and the modes of payment of the fee for usage of motorway or national road, their section or structures on the road (hereinafter-motorway tax)

                                                 Article 2
The fee for usage of a motorway or national road , their section or structures on the road (motorway tax) is established on the basis of the amount of the fee that is paid for each passed kilometer , the vehicle’s category and the length of the section.

                                                 Article 3
The amount of the fee for each passed kilometer is established on the basis of the average price paid for construction of a kilometer road (one lane), the average daily traffic in the current year and the period of the amortization.
According to the previously named parameters, the amount of the fee for each passed kilometer shall be 2,5789 denars.
The motorway fee according to the vehicle’s category, is calculated when the amount of the fee for each passed kilometer will be multiplied with the length of the section on the motorway.
The calculation of the motorway tax is made with calculation of the amounts on 10 denars (from 1,00 to 4,99 on the lower value and from 5,oo to 9,99 on the higher value).

                                                 Article 4
According to the vehicle’s type, the number of axes and the height at the front hub, the vehicles are divided in the following four categories :First category : vehicles with two axes and height at the front axe till 1,3 meters ; Second category : vehicles with more that two axes and height at the front axe till 1,3 meters;Third category : vehicles with two and tree axes and height at the front axe of 1,3 meters and more;Fourth category : vehicles with more than tree axes and height at the front axe of 1,3 meters.

The height of the vehicle at the front axe is measured vertically from the carriageway till the highest point at the vehicle, over the front axe

                                                 Article 5
The value of the motorway tax, for the different types of categories of vehicles,  is defined in the following ways

The motorway tax that is collected in the Republic of Macedonia established with article 3 of this decision is :

                                                 Article 7
The payment of the motorway tax users can make in two ways : cash and electronic payment.

                                                 Article 8
On the day when this decision enters into force, shall be no longer valid the Decision for the fee that is paid for usage of a motorway and its section (“ Official Gazette of Republic of Macedonia” number 52/00).

                                                 Article 9
This decision shall enter into force the day after publishing in the “Official Gazette  of Republic of Macedonia” , and it shall be enforced from January 1, 2008.
